1. Eligibility and Artwork Selection

• Promotion:  ‘The Art of Glenfiddich’ - a collaboration between Glenfiddich, The Whisky Exchange and Rise Art (the “Promotion”).
• Eligibility: This Promotion is available only to customers aged 18 or over residing in England, Scotland or Wales with purchases of Glenfiddich’s Time Re:Imagined Collection and Grand Series via The Whisky Exchange (the “Promotion Products”) in the period  between December 3, 2024 and February 28, 2025 (the “Promotion Period”) and while Promotion Voucher stocks last. Promotion Voucher stocks are subject to availability: 369 rentals available in total. 
• Artwork Collections: Each Promotion Product purchased from The Whisky Exchange during the Promotion Period is associated with a Rise Art curated collection of artworks available to rent (“Promotion Artworks”) and availability will be dependant on a tier system, as more particularly set out in 2 below (the “Tier(s)”).
• Tier-Based Selection: Upon purchase of a Promotion Product, a voucher (with a unique code) (the “Promotion Voucher”) will be allocated to the customer (“Promotion Voucher Holder”) and included in the packaging of the Promotion Products. A Promotion Voucher Holder may only  select one artwork to rent from the associated Artwork Collection (the “Promotion Rental”).
• Requirements: The Promotion Voucher Holder will need to provide both the Promotion Voucher and a proof of purchase of a Promotion Product (email will suffice) to access this Promotion.  Rise Art reserves the right to disqualify any Promotion Voucher Holder from this Promotion where proof of purchase is not provided or fraud can be determined.
  

2. Promotion Tiers

The Promotion Products included in this Promotion are the following products from the Glenfiddich Grand Series and Time Re: Imagined ranges: : Glenfiddich 21 Year Old Gran Reserva, Glenfiddich 23 Year Old Grand Cru, Glenfiddich 26 Year Old Grande Couronne, Glenfiddich 29 Year Old Grand Yozakura, Glenfiddich 31 Year Old Grand Château, Glenfiddich 30 Year Old Suspended Time, Glenfiddich 40 Year Old Cumulative Time, and Glenfiddich 50 Year Old Simultaneous Time.

Each Promotion Voucher shall be eligible for one Promotion Rental and, where applicable based on each Tier,  additional services which include:

• Art Advisory Session: The Promotion Voucher Holder may elect to book a 30 minute art advisory session over phone or video call prior to making their selection. To redeem this complimentary session, the Promotion Voucher Holder must contact Rise Art at [email protected] to book. 
• Premium Delivery Service: Rise Art shall arrange for a specialist courier service to deliver the Promotion Artwork within a scheduled two-hour delivery window.
• White Glove Installation: Rise Art will arrange for an art installer to visit the Promotion Voucher Holder to install the Promotion Artwork. Possibly on the same day as delivery.
• Pack and Return: At the end of the agreed rental period, Rise Art will arrange for a Pack and Send or similar to come to the Promotion Voucher Holder’s home to collect, pack, and ship the  Promotion Artwork back. 

The Tiers are set out below based on each Promotion Product:

• Promotion Rental Duration: 1 month.
• Maximum Available Promotion Vouchers: 10.
• Additional Services:  None.
• Glenfiddich 31 Year Old Grand Château:
  
• Promotion Rental Duration: 1 month.
• Maximum Available Promotion Vouchers: 90.
• Additional Services:  None.
• Time Reimagined Series:
• Glenfiddich 30 Year Old Suspended Time:
  
• Promotion Rental Duration: 1 month.
• Maximum Available Promotion Vouchers: 20.

• Promotion Rental Duration: 3 months.
• Maximum Available Promotion Vouchers: 2.
• Additional Services:  Art Advisory Session, Premium Delivery Service, White Glove Installation, Pack and Return.
  

3. Redemption, Participating Countries and Exclusions

• Redemption: A Promotion Voucher shall be redeemable for a Promotion Rental for the Promotion Rental Duration and, where applicable, additional services as defined for each Promotion Product Tier. All Promotion Vouchers need to be redeemed by February 28, 2025 at the latest.
• Eligible Countries: The Promotion is only available to residents of England, Scotland, and Wales. The Promotion is not available to residents of Northern Ireland.
• Redemption After February 28, 2025: Promotion Voucher Holders may still contact Rise Art at [email protected] to redeem their Promotion Voucher. An amount equivalent to the rental amount will be credited to their account in lieu of the Promotion Rental. The amount credited for each Promotion Voucher will be defined by Rise Art based on the Promotion Voucher Tier. The credit can be used on the Rise Art platform against any purchase or rental, and will expire if unused by June 1st 2025. Any unclaimed Promotion Voucher or unused credit after June 1st 2025 will automatically expire and will be unredeemable.
  

4. Shipping and Delivery

• Shipping Address: The  Promotion Voucher Holder shall provide a valid physical address (PO box not applicable) within England, Scotland and Wales for delivery of the Promotion Artwork, and the Promotion Artwork shall remain at that address for the entirety of the Promotion Rental Duration and any renewals thereof.
• Shipping Fees Included: Shipping is free of charge in England, Scotland, and Wales.
• Artwork Ownership: Ownership of the Promotion Artwork rests solely with Rise Art, its sellers or partners throughout the entirety of the Promotion Rental.
  

5. Damage Waiver, Insurance and Fraud

• Damage Liability Waiver: A damage liability waiver is included during the Promotion Rental Duration. The Damage Liability Waiver reduces the Promotion Voucher Holder’s liability in cases of accidental damage and some instances of theft to no more than 10% of the retail value of the Promotion Artwork rented or £100, whichever is greater. For reference, terms for the Damage Liability Waiver are provided in the Rental Agreement.
• Card Details Required: Rise Art must obtain the Promotion Voucher Holder’s card details upon redemption, and a non-refundable nominal fee of one (1.00) pound sterling will be charged to validate the card details. This is to facilitate renewal of the rental beyond the Promotion Duration (if the Promotion Voucher Holders elects to do so) or ensure recourse if the Promotion Artwork is not returned or is damaged following the Promotion Rental Duration or if there is a need to collect any fees under these Terms & Conditions.
• KYC, Fraud and Credit Checks: Rise Art shall carry out Know Your Customer (KYC) checks on a Promotion Voucher Holder where the Promotion Art value in the Promotion Rental is over ten thousand (10,000.00) Euros to comply with Anti Money Laundry Regulations (AML) in the United Kingdom. Rise Art may also carry out fraud and credit checks on a Promotion Voucher Holder. Failure to provide the required information or pass the checks will render the Promotion Voucher Code void.
• Insurance: In addition to the Damage Liability Waiver, Rise Art may require that the Promotion Voucher Holders provide proof of insurance for Promotion Rentals where the value of the Promotion Artwork is over ten thousand (10,000.00) Euros. The need for insurance and the required coverage amount will be determined by Rise Art on a case-by-case basis. Promotion Voucher Holders can contact Rise Art at [email protected] for advice . 
• Rental Agreement:  All Promotion Voucher Holders will be required to agree to the Rental Agreement during checkout. The Rental Agreement shall apply only to all Promotion Artworks not purchased or returned after the Promotion Rental Duration has expired.
  

6. Returns, Purchases and Renewals

• Artwork Return: Rise Art will email the Promotion Voucher Holder at least ten (10) days before the end of the Promotion Rental Duration. Should the Promotion Voucher Holder elect not to renew their rental following the  Promotion Rental Duration, they must notify Rise Art, by way of email, at least three (3) days before the end of the Promotion Rental Duration. Upon receipt of such notification, Rise Art will provide a prepaid shipping label for the Promotion Artwork return.
• Purchase Conversion: Promotion Voucher Holders can elect to purchase the Promotion Artwork at the end of the Promotion Rental Duration. Rise Art will credit towards the Promotion Artwork purchase price the equivalent of the rental amount minus any shipping and Damage Liability Waiver amounts incurred during the Promotion Rental Duration.
• Rental Renewal: All Promotion Rentals are available for renewal at the end of the Promotion Rental Duration. Upon renewal, the terms of the Rental Agreement will apply to the rental, and the rental will automatically renew each month until cancelled by the Promotion Voucher Holder and the Promotion Artwork returned. After renewal,  the Promotion Voucher Holder will be responsible for all monthly rental fees, including the rental fee and the Damage Liability Waiver fee, and the Promotion Voucher Holder authorises Rise Art to charge each month the credit or debit card provided by the Promotion Voucher Holder at the commencement of the Promotion Rental Period.
• Notification Requirement: Those wishing to renew their Promotion Rental or convert their Promotion Rental to a purchase must inform Rise Art of their intention no less than three (3) days prior to the end of their Promotion Rental Duration.
• Automatic Renewal: If the Promotion Voucher Holder fails to notify Rise Art of their intention to purchase or return the Promotion Artwork, complete the purchase of the Promotion Artwork by the end of the Promotion Rental Duration or return the Promotion Artwork by the agreed-upon date as specified in the rental return emails, they authorise Rise Art to automatically renew the rental. Payment for this extended rental period will be charged to the credit or debit card provided by the Consumer at the commencement of the initial rental agreement.

7. Lost and Redeemed Vouchers

• Once a Promotion Voucher is redeemed, it is void and cannot be reused.
• The Promotion Voucher is intended for either the recipient or purchaser of the Promotion Product and is non-transferable beyond these persons. No cash alternatives will be offered.
• It is the Promotion Voucher Holder’s  responsibility to safeguard their Promotion Voucher. Rise Art recommends storing Promotion Vouchers in a secure location. 
• All Promotion Vouchers are unique and cannot be replaced if damaged, lost or stolen.
  

8. Miscellaneous

• Other Discounts and Promotions: Vouchers for this campaign cannot be used in conjunction with any other discounts or promotions on Rise Art.
• Privacy:  Rise Art will handle all personal information in accordance with applicable UK data protection laws. The Promotion Voucher’s data will only be used for purposes related to this Promotion.
• Limitation of Liability: In no event shall Rise Art, or any parent, subsidiary, affiliate, director, officer, employee, licensor, distributor, supplier, agent, reseller, owner, or operator of Rise Art, be liable to the Promotion Voucher Holder for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any (I) errors, mistakes, or inaccuracies of content, (II) Personal injury or property damage, of any nature whatsoever, resulting from your participation in this Promotion or your access and use of any Promotion website or Rise Art owned or operated website (each a “Website” and together the “Websites”), (III) Any unauthorised access to or use of our secure servers and/or any and all personal information stored therein, (IV) Any interruption or cessation of transmission to or from the Websites, (V) Any bugs, viruses, trojan horses, or the like which may be transmitted to our through the Websites by any third party, and /or (VI) Any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available, whether based on warranty, contract, tort, or any other legal theory, and whether or not the company is advised of the possibility of such damages. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.
• Indemnity: You agree to defend, indemnify and hold harmless Rise Art, and any parent, subsidiary, affiliate, director, officer, employee, licensor, distributor, supplier, agent, reseller, owner, or operator of Rise Art, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorneys fees) arising from: (i) your use of and access to any Website; (ii) your violation of these Te  rms & Conditions; or (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right. This defence and indemnification obligation will survive these Terms & Conditions.
• The Promotion Voucher Holders acknowledge that neither William Grant & Sons nor The Whisky Exchange have any obligations in relation to this Promotion and these Terms & Conditions or otherwise and the Promotion Voucher Holder will not contact William Grant & Sons nor The Whisky Exchange directly for any reason.
• Rise Art reserves the right to amend these Terms & Conditions or cancel the Promotion at any time without notice.
• Governing Law: These Terms & Conditions shall be governed by the laws of England and Wales.
